Judge says religion not valid for female genital mutilation, jails doctor & his wife

On May 3 a U.S. federal judge denied bail at a hearing for a doctor and his wife arrested April 21 for participating in female genital mutilation (FGM). Dr. Fakhruddin Attar, 53, and his wife, Farida Attar, 50, of Livonia, Michigan, were found out during a federal investigation into Dr. Jumana Nagarwala, who was arrested on April 12 for FGM. Dr. Attar and his wife were found to be a flight risk since they are from India, so Judge Elizabeth Stafford denied bail for the defendants, sending them back to jail.

The attorney for the defendants argued that the procedure they helped Nagarwala with was a deeply held Muslim religious tradition and was not FGM, but was a harmless removal of a vaginal membrane of two 7-yr-old girls at the request of their parents. Judge Stafford rejected the religious claim outright, deeming the procedure painful and harmful to the girls as well as illegal.

Dr. Attar did not perform FGM himself but allowed Dr. Nagarwala to do the procedures at his clinic while he was there and while his wife held the girls’ hands during the FGM. The doctors are part of an international community that promotes FGM–the same community that was busted in Australia in 2015 for the same thing. When the Attars realized the authorities were closing in on them, they called parents  and others in their community to tell them to keep quiet and deny everything they knew about the situation.

The U.S. Attorney prosecuting the case said they are still tracking down other victims, especially since Dr. Attar admitted Dr. Nagarwala “treated several girls aged 6-9 after hours in his clinic. The two girls that prompted the case were taken from Minnesota to Michigan for the FGM, which has sparked legislators in Minnesota to consider a bill targeting the barbaric procedure. A key piece of evidence in the case is security video footage of the parking lot showing the girls going to the clinic at the times of the said incidents.
