American Islamic organization’s legal maneuver fails

U.S. District Court Judge Colleen Kollar-Kotelly of the District of Columbia has thrown out a request made by the Council on American-Islamic Relations (CAIR) to re-file a lawsuit against a father and son team that exposed their terrorist ties.  Lawyers for the defendants claim CAIR re-filed the same exact lawsuit they previously filed with the court against the defendants.  They believe it was a legal maneuver from the organization to quash the free speech rights of anyone who criticizes them by attempting to make them start the whole legal process over again after many hours were already placed into fighting the original suit started by CAIR.  This, in effect, would drive up the defendants’ legal costs to make it cost-prohibitive to defend themselves.

The father-son team of Air Force special agent P. David Gaubatz and Chris Gaubatz executed an undercover operation of CAIR.  Chris Gaubatz posed as a Muslim convert to get an internship with CAIR in 2008.  As an intern he was told to shred documents that he determined revealed that CAIR was being funded by the Saudis and that the organization had ties to the Muslim Brotherhood, an Egypt-based terrorist organization.  Those documents revealed that CAIR was acting as a front for the Muslim Brotherhood to blend into American society with the hope of bringing Saudi-style Islamic law to the U.S.

What was discovered in the documents by Chris Gaubatz was revealed in his book, “The Muslim Mafia.”  CAIR, after the book was published, filed suit claiming Chris Gaubatz obtained the documents unlawfully.  However, the suit never denied that the Gaubatzes claims in the book were true and CAIR never specified any damages they suffered as a result of the book.

Chris Gaubatz obtained the documents lawfully, claims WorldNetDaily, Gaubatz’s publisher.  Since Gaubatz realized the documents had information that could affect national security, he sought the advice of legal counsel who told him to hang on to them.  The attorney for the Gaubatzes also says that all documents were returned to CAIR and that CAIR did not hold to the objections it had when the FBI subpoenaed their documents for a federal grand jury.

Judge Kollar-Kotelly informed the plaintiffs that they didn’t have the right to re-file the same case since their initial suit was fully briefed but they could, by March 1, file a motion for leave to amend their original lawsuit.

CAIR’s operations in the U.S. is proof that America faces a clear and present danger.  America, the bastion of freedom and God’s blessings, faces enemies who want to bring those freedoms to an end to bring about their own evil, destructive ideals.  It is by God’s grace working through the wisdom of concerned U.S. citizens that we have not fallen yet.
